Seek expert legal advice before New Year divorce, says Law Society
With January 4th inauspiciously labelled as ‘Divorce D-Day’, the Law Society has called for unhappy spouses to seek expert legal advice from specialist family law solicitors before beginning divorce proceedings.
Without contacting the necessary specialist before a divorce, the Law Society has warned that the whole process could become slower and more painful than is necessary during an already very difficult and emotional time.
Robert Heslett, Law Society President, said: "Divorce is stressful, the legalities can be complicated and emotions can cloud reasoning, so it is important to consult an expert from the outset to receive independent, impartial, objective advice from someone who will steer you clear of the legal pitfalls and safeguard your interests."
Family law experts can make sure that all the complex and more finite issues of a divorce run smoothly. Deciding the financial settlement, the time the children spend with each parent and other contentious issues in an efficient, non-acrimonious manner can also save substantial amounts of money in legal fees.
“Solicitors will sort the wheat from the chaff, give tactical advice and may even save you time and money,” he added.
Solicitors can also advise on matters that are separate from court and keep family affairs away from a judge’s eyes. Other options available, such as mediation or collaborative family law which help resolve issues following family breakdown in a calm and constructive manner, can keep the courts at bay.
“Before agreeing matters with your partner, it is advisable to consult a family law specialist solicitor who will advise you about your rights and the options available to you.”
