The BBC’s The One Show recently highlighted the unfortunate case of a man who was hit by a car and survived for 3 years in a coma.
The man’s wife found that she had no access to investments in her husband’s name and had to apply to the Court for authority to access the funds. Not only was this expensive and time consuming but it also meant that she had to ask the Court for permission whenever she needed extra money, e.g. for her daughter’s University fees.
If her husband had only prepared a Lasting Power of Attorney in his wife’s favour before the accident then all the inconvenience and expense could have been avoided.
It is now official Government advice that everyone ought to have a Lasting Power of Attorney in place and, certainly, without one it cannot be said that one’s affairs are entirely in order.
