Family Fortunes - A Seminar on Prenuptial & Postnuptial Agreements

This morning, Seddons Family Department hosted its first breakfast seminar, entitled ‘Family Fortunes’, which dealt with the developing area of law surrounding prenuptial and postnuptial agreements.

In the traditional and opulent setting of the Durrants Hotel on George Street, a congregation of eager delegates assembled at 8am for pastries and bacon sandwiches to hear members of the Family Team speak on this increasingly common topic for couples seeking guidance on protecting their position.

After a short introduction from the Head of Family, Deborah Jeff, partner Margaret Kelly delivered a history of prenuptial and postnuptial agreements in this jurisdiction. David Lillywhite then spoke about the kind of client who should be considering one of these agreements before addressing the current position regarding prenuptial and postnuptial agreements and the Government and judiciary’s failure to take responsibility for the same.

This led neatly into Deborah’s return to the lectern to talk about the guidance the Courts are currently offering practitioners through the burgeoning number of cases dealing with this complex topic. After taking the enthralled audience through the cases of Crossley v Crossley, MacLeod v MacLeod and Radmacher v Granatino (the Supreme Court decision on which is due shortly), the department held an extended Question & Answer session with the delegates, who had clearly been paying attention even at such an early hour!

The seminar was a great success with an audience keen to hear more about this interesting subject.
