Buying or selling a house? – Make sure you get the right advice

There have been several recent reforms announced to assist people in obtaining proper and professional advice in property matters.

The Law Society has introduced a Conveyancing Quality Scheme that will offer a recognised Conveyancing Quality Standard that firms of solicitors can obtain if they are found to meet sufficiently high standards of practice and advice in conveyancing matters. The standard will provide the public with a clear indication that the firm in question is complying with good practice management standards and conveyancing procedures through the scheme protocol, making it easier for them to choose a competent legal advisor for their transaction. It will also provide another marketing tool for competent law forms to use to stand out from the increasing number of businesses that are now offering property advice and assistance. The standard will assist those law firms who want to reassure clients that they are offering only the highest standards of legal advice.

The National Association of Estate Agents has introduced a licensing system for branches of estate agents. The licence will be granted to firms where at least one agent has the necessary qualifications and/or experience in conveyancing transactions. The Association states that the system should increase standards in the industry and encourage firms to improve their professionalism and integrity, as well as having the more general effect of increasing confidence in the housing market.

The Office of Fair Trading has also introduced a policy that will impose financial penalties on estate agents that do not register under its anti-money laundering scheme. The scheme aims to improve transparency by registered members in conveyancing transactions, which are often used by money launderers to clean their money.
