Enfranchisement

Seddons Enfranchisement Team members have considerable experience offering help and advice on all aspects of Leasehold Enfranchisement.

We represent collective groups of tenants who wish to purchase the freehold of a house or block of flats, and individual tenants who wish to extend their own lease term by 90 years.

We also advise on, and manage applications by tenants who wish to use the Right to Manage legislation to take over the future management and control of their buildings.

We similarly advise landlords were called upon to either verify tenant entitlement, and to effectively manage such applications where rights or values are in issue.

The Property Litigation team have extensive experience in the Leasehold Valuation Tribunal and Lands Tribunal on a whole range of contentious business.


Tenants rights to extend their Lease

Qualifying tenants have a statutory right to a 90-year term extension, subject to the payment of an appropriate premium and limited landlords costs. The criteria requires 2 years ownership to apply, but it is possible to buy a flat with an existing right from the previous owner in certain circumstances. Seddons can assist you with establishing your entitlement, in finding a suitable valuer to set the likely premium, and in preparing the relevant notices, and with all aspects of the remaining procedure through to completion.

Collective Enfranchisement

Subject to certain qualifying conditions, a sufficient number of qualifying tenants can collectively apply under current legislation to purchase the freehold of their building from their landlord subject to paying the appropriate premium and costs. We have the relevant specialist experience to talk you through the process, verify whether or not you might qualify, and then work with your group and valuers to complete the acquisition process. Our Company colleagues will handle the company formation necessary to create the vehicle to hold and thereafter manage the building for the tenant owners

Freehold Purchase of a House

Long lessees of a house can qualify to acquire that freehold from their landlord subject to the payment of an appropriate premium and costs. We can assist you in every aspect of that process and with valuation matters


Right to Manage

Nowadays, qualifying tenants may use Right to Manage legislation to take permanent control of the management of their building from the freeholder or any intermediary management company. We can assist with setting up the Right to Manage Company and giving ongoing advice as to the correct management obligations and procedures to follow in the future. We regularly give general advice on service charge matters, tenant rights, and residual landlord rights once management passes to the tenants.
