LETTER OF WISHES

Letters of Wishes are semi-formal documents signed by the person setting up a discretionary trust (the “settlor”) stating how he would wish the trustees to exercise their discretion in certain defined circumstances .

These documents are not binding on the trustees (indeed the whole point is that they are not) but in general trustees will act in accordance with their terms as a matter of moral but not legal obligation.
