Collaborative Law
Collaborative Law is a new approach. It generates a dignified and co-operative attitude to negotiating and settling issues (finances and children) arising from divorce or family separation.
The collaborative law process may be for you if:
- You wish to have a dignified and non–aggressive resolution of the issues arising from the breakdown of your relationship;
- You and your partner have children and wish to keep the children’s needs and interests at the forefront of the decision making, retaining a good relationship as parents;
- You wish to maintain a continuing (although changed) and amicable relationship with your partner, mutual friends and members of each other’s families; or
- You wish to retain control over decision making in issues arising from the ending of your relationship.
The collaborative process is probably not for you if:
- Your main aim in the process is to seek revenge or make your partner suffer;
- You are too bound up with emotion and cannot separate this from the need to resolve issues;
- You feel under threat from your spouse or partner;
- You know that your partner will be dishonest and will try to hide their true financial circumstances; or
- You wish decisions to be made by a court or a judge in any event.
