Letters of Wishes

Letters of Wishes are semi-formal documents signed by the person setting up a discretionary trust (the “settlor”) stating how he would wish the trustees to exercise their discretion in certain defined circumstances.

These documents are not binding on the trustees (indeed the whole point is that they are not) but in general trustees will act in accordance with their terms as a matter of moral but not legal obligation.
