ENDURING POWERS OF ATTORNEYAn Enduring Power of Attorney is a legal document used by one person (the “donor”) to give power over their financial affairs to another person or persons (the “attorney(s)”). The power can be tailored to individual requirements so that it relates to all of the donor’s affairs or only to some of them, e.g. the sale of a property where the owner resides abroad. Often the power is drafted in such a manner that it will only come into force if the donor becomes incapacitated and it is sometimes prudent for the elderly to grant this type of Power of Attorney in favour of their spouse and/or a child or children. |
