    Dispute Resolution

    These costs apply where your claim is in relation to an unpaid invoice which is not disputed and enforcement action is not needed.

    We will offer you a choice of either:

    1. A single fixed fee for all work up to but not including the issue of proceedings or
    2. A contingency fee which is payable only if the claim is resolved successfully and payment is received in whole or in part. Again the fee will cover all work up to, but not including, the issue of proceedings (we are not permitted to offer contingency fees for work following the issue of court proceedings).

    If the other party disputes your claim at any point, we will discuss any further work required and provide you with revised advice about costs if necessary, including the costs of issuing proceedings, the risk of adverse costs and the availability of ate insurance.

    Anyone wishing to proceed with a claim should note that:

    • the VAT element of our fee cannot be reclaimed from your debtor;
    • interest and compensation may take the debt into a higher banding, with a higher cost;
    • the costs quoted above are not for matters where enforcement action, such as instructing a bailiff, is needed to collect your debt.

    Our fee includes:

    • taking your instructions and reviewing documentation;
    • undertaking appropriate searches;
    • sending a letter before action;
    • receiving payment and sending onto you.

    Unless the debtor is insolvent or cannot be traced, matters usually take 2-8 weeks from receipt of instructions from you, to receipt of payment (or offer of payment by instalments). If court action is needed, the matter will take longer to resolve. We will discuss the costs of drafting and issuing proceedings with you on a case by case basis.

    In suitable cases we will offer a conditional fee agreement. Our work on court proceedings will be charged on the basis of our hourly rates, plus disbursements including the court fee, which will usually be 5% of the amount of the debt, up to a maximum of £10,000.
