David has over 20 years experience of civil dispute resolution. He has acted for clients both corporate and individual, domestic and international, and generally in matters which require a sensitive approach to the issues; an appreciation of detail; and a forensic analysis of the facts and application of the law. He is known for his dogged approach to complicated matters and his commitment to his clients and their interests. David has always tried to obtain the desired results through negotiation and mediation where possible.
- Advising Insolvency Practitioner Insurer on debt collection with relation to fraudulent practitioners resulting in recovery of indemnity payment from defaulting practitioner
- Defending a commercial client who had become involved in onerous invoice factoring agreements
- Advising a commercial client with relation to a large cheque fraud by their financial director
- Successfully defending a distinguished academic against allegations of professional misconduct
- Advising a commercial client in relation to website passing off and intellectual property infringement
- Defending a dealer in vintage motorcycles against an allegation of conversion
- Debt collection for various international commercial clients including a law firm in South Africa and a Trustee in Bankruptcy in Belgium
- Assisting various individual clients to set aside Judgments and Court Orders which were wrongfully obtained
- Advising on the effect of Deeds of Guarantee and Contractual Indemnity against institutional lenders
- Lead solicitor in a 21 party property company fraud which was resolved successfully with our Clients recovering over 100 stolen properties worth over £32m.
- Asset recovery including obtaining Charging Orders and Orders for Sale
- Enforcing Foreign Judgments
- Advising on and obtaining restoration of companies struck off the Register to allow the transfer of assets which would have been lost to creditors
- Advising a Dutch company in an international arbitration with a Spanish company in dispute about the production and supply of electric generators
- Successfully defending company directors of a large cleaning company against criminal charges of conspiracy to corrupt
- Acting for a Turkish Industrial distributor in the appeal of a breach of contract claim and counterclaim against UK Supplier for breach of a duty of good faith
- Defending company shareholders from an Unfair Prejudice petition
- Advising a shareholder on a possible Unfair Prejudice claim arising from a leaver valuation
- Acting for a claimant company in a claim for compensation under the Commercial Agency Regulations after the termination of an agency contract relating to the sale of digital software products
